1. Not A Textbook (Educational Disclaimer)

Expeditione is designed to make learning engaging and memorable. However, the information provided is for general educational and entertainment purposes only. While I strive for high standards of historical and scientific accuracy, I make no legal guarantees. I am not liable for any academic outcomes, test scores, or real-world decisions made based on the content of these expeditions.

2. Limitation of Liability ("As-Is")

I provide this platform "as is" without any warranties, express or implied. Because I am pushing the limits of web rendering, I do not guarantee that the site will be completely free of bugs, downtime, or rendering issues on older devices. I am not liable for any direct or indirect damages resulting from your use of the website.

3. Intellectual Property & Asset Protection

The code, design, text, narrative structure, and custom 3D assets (unless otherwise explicitly credited) are my intellectual property. You may not scrape, reverse-engineer, or use automated tools to extract materials, textures, or models from the WebGL canvas. Any unauthorized commercial redistribution of my interactive content is strictly prohibited except as expressly permitted in writing. See Section 24 for details on Commercial & Enterprise Licensing.

4. Acceptable Use

You agree to respect the platform. In addition to compliance with all local and international laws, you are strictly prohibited from the following:

• Using automated bots or scripts to scrape data or extract 3D assets.
• Attempting to probe, scan, or test system vulnerabilities.
• Interfering with or disrupting servers, networks, or infrastructure.
• Impersonating another user, entity, or the platform creator.
• Attempting to bypass any age-gating or verification systems.

5. Third-Party Credits & Inspiration

Expeditione wouldn't be possible without open-source tools and community inspiration. I explicitly credit these tools (Three.js, Blender, GSAP) and specific model inspirations (Sketchfab, Polygon Runway) in my credits sections. All third-party trademarks belong to their respective owners.

6. Educators & Schools

If you are an educator or school representative using Expeditione in an official capacity, you represent that you have the authority to consent to my data practices on behalf of your students. Expeditione collects minimal, privacy-respecting data as described in the Privacy Policy, including anonymous usage metrics and optional email communication data. Expeditione does not maintain student records. Responsibility for compliance with applicable student data protection and privacy laws rests with the educational institution.

7. Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of India. By using this interactive encyclopedia, you agree that the courts of the Republic of India shall have jurisdiction to settle any dispute or claim.

8. Right to Terminate & Restrict Access

I reserve the right to block, restrict, or terminate access to Expeditione for any user, IP address, or network at my sole discretion, at any time, and without prior notice. This applies particularly, but not exclusively, if these terms are violated, if automated scraping is detected, or if server stability and security are threatened.

9. Severability

If any provision or part-provision of these Terms is or becomes invalid, illegal, or unenforceable by a court of competent jurisdiction, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification or deletion of a provision shall not affect the validity and enforceability of the rest of these Terms.

10. Indemnification

You agree to indemnify and hold harmless Expeditione and its creator from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising directly or indirectly from your misuse of the platform, your violation of these Terms, or your infringement of any intellectual property or privacy rights.

11. Force Majeure

I shall not be in breach of these Terms nor liable for any delay in performing, or failure to perform, any obligations under these Terms if such delay or failure results from events, circumstances, or causes beyond my reasonable control. This includes, but is not limited to, global network disruptions, undersea cable failures, force of mother nature, infrastructure outages, or third-party service failures (e.g., Cloudflare or hosting downtime).

12. Third-Party Links & External Services

Expeditione may contain links to external historical archives, educational resources, or third-party platforms. I do not endorse, monitor, or have any control over the content, privacy policies, or security practices of these external sites. Once you leave the Expeditione domain, you do so entirely at your own risk, and I accept no liability for any damages or losses incurred from your use of third-party services.

13. No Waiver of Rights

If I do not immediately enforce any provision of these Terms, or if I delay in exercising any right or remedy, it shall not constitute a waiver of that right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. A waiver of any right or remedy is only effective if given in writing.

14. Class Action Waiver

You agree that any legal dispute, claim, or controversy arising out of or relating to these Terms or the use of Expeditione must be brought exclusively in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The court may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

15. Time Limitation on Claims

You agree that any claim or cause of action arising out of or related to your use of Expeditione or these Terms must be filed within one (1) year after such claim or cause of action arose. If not filed within this one-year period, such claim or cause of action is barred to the extent permitted by applicable law, regardless of any statute or law to the contrary.

16. Unsolicited Feedback and Suggestions

If you choose to submit comments, ideas, suggestions, or feedback regarding Expeditione, you agree that I am free to use, modify, and incorporate them into the platform without any restriction, compensation, or attribution to you. You irrevocably assign all rights, title, and interest in such feedback to Expeditione.

17. Anti-Scraping and AI Training Prohibition

You are strictly prohibited from using, downloading, scraping, or extracting any content, text, 3D geometry, shaders, or architectural logic from Expeditione for the purpose of developing, training, fine-tuning, or powering any artificial intelligence system, large language model (LLM), machine learning algorithm, or generative AI platform without my express, prior written consent. Furthermore, you may not use screenings, renderings, or any visual output from the platform to generate "Synthetic Datasets" for the purpose of training Vision Models or Image-to-3D algorithms.

18. Language and Translation

These Terms of Service were originally drafted in the English language. If these Terms are translated into any other language for convenience or localization, the English version shall govern in the event of any conflict, ambiguity, or discrepancy between the English text and the translated text.

19. Amendments & Updates

I may amend, modify, or update these Terms of Service at any time to reflect changes in the law, technical infrastructure, or platform features. It is your responsibility to check this page periodically for updates. Your continued use of Expeditione following the posting of any changes indicates your acceptance of the revised Terms.

20. Service Availability

Expeditione is an evolving platform. I may modify, suspend, or discontinue any part of the service at any time without notice. I am not liable for any impact resulting from such changes.

21. Physical Safety & Real-World Interpretation

Expeditione is a digital simulation designed for educational purposes. All 3D models, depths, soil layers, and geological data are stylized representations. You are strictly prohibited from using the platform as a guide for real-world excavation, geological exploration, structural engineering, or agricultural activity. I accept no liability for any physical injury, property damage, or legal violations occurring if you attempt to replicate or respond to the content of this platform in the physical world.

22. Digital Accessibility Limitations

Expeditione is fundamentally a highly visual, WebGL-based 3D simulation. While the core mission is to make education engaging and memorable, the underlying technology relies on spatial, graphical rendering via the HTML Canvas element. Consequently, the 3D environments may not be fully compatible with standard screen readers or text-to-speech assistive technologies. By accessing the platform, you acknowledge the inherent accessibility limitations of custom spatial computing and WebGL architecture. I continue to explore ways to improve accessibility where feasible.

23. Entire Agreement

These Terms of Service, alongside the Privacy Policy, constitute the entire agreement between you and Expeditione regarding your use of the platform. They supersede and extinguish all previous agreements, promises, assurances, warranties, representations, and understandings between us, whether written or oral, relating to the platform.

24. Commercial & Enterprise Licensing

The free access granted by these Terms of Service is strictly for individual, personal, and non-commercial educational use. Any use of Expeditione—including its WebGL environments, assets, code, or narratives—for commercial purposes, public exhibitions, corporate presentations, institutional integration, or revenue-generating activities is strictly prohibited without an explicit, written Enterprise License Agreement.

If your organization wishes to license Expeditione for commercial or institutional use, you must submit a formal request to aureon@expeditione.fun using the exact subject line "Enterprise License Request". I reserve the right to grant or deny Enterprise Licenses at my sole discretion.
